Smartphone Evidence on the Rise

A classic scene from old movies is the private investigator hired to see whether or not a spouse is cheating or not. These days, we carry around our own private investigator in the form of smart phones and social media. According to a survey from the American Academy of Matrimonial Lawyers, 97% of those surveyed said they've seen an increase in evidence taken from smart phones and other wireless devices in the past three years.

The most common piece of evidence taken was texts, followed by emails, and finally phone numbers and call history. The top apps used to prove infidelity were Find My iPhone, which reveals the location of an iPhone via GPS, and Snapchat, a picture-sharing app that destroys images soon after viewing.

We do not recommend snooping around on your spouse's mobile devices looking for evidence of infidelity. This shows a lack of trust in your partner that will erode a marriage regardless of infidelity.
